V.I.P. Personnel Candidate Agreement
V.I.P. Personnel Candidate Agreement This document sets out the Terms and Conditions of employment under which you will be engaged with V.I.P. Personnel (thereafter VIP). It is declared that the information provided to VIP is true and correct. Permission is granted to VIP to seek confirmation of your employment details, conduct reference checks and to pass on relevant information to other parties (including prospective Clients). 1. Definitions 1.1 In this Agreement: "Assignment(s) Shift(s)" means working as one of our employees doing work for one of our Clients on a temporary/casual basis as described in any job description that VIP may be obliged to provide and as may be varied by VIP from time to time; "Misconduct" includes dishonesty, fraud on VIP or our Clients and any harassment of our employees or Clients; "You" or "your" refers to the applicant/candidate. 2. General Terms & Conditions of Casual (Hourly on Hire) Employment 2.1 It is acknowledged that you accept that you are under the care, direction and supervision of VIP's Clients during the period of any Client assignment. The Clients care and supervision relates to the defined working hours, Client specific regulations and policies, and the manner and proficiency in which your work is to be performed. 2.2 It is acknowledged and understood that when engaged by VIP as a Casual (Hourly On Hire) Employee in accordance with one or more of the following industrial instruments (as appropriate): . An enterprise agreement certified in accordance with the relevant federal or state statutory requirements, where work is performed in a classification referred to in that agreement: or . In the event that you are required to perform work that is not covered by an award/agreement VIP will communicate the rates, terms and conditions for that Client assignment. 2.3 It is accepted that each casual assignment is a separate period of employment, that VIP does not control the length of any Client assignment and that the Client may vary or terminate the assignment at one (1) hours notice. 2.4 In the event of a variation to an assignment or upon the commencement of a new assignment the provisions of the Declaration will be unaffected and shall remain in force until replaced or varied. 2.5 Any training/induction provided by VIP/Client that requires undertaking will not be paid for by VIP/Client unless otherwise agreed by the Client. 2.6 It is declared that you are an Australian Resident are lawfully entitled to work and/or hold the appropriate visa permitting you to work in Australia 3 Application This agreement will apply after you have completed VIP's application forms, successfully gained employment with VIP and advised that you are able to accept assignments/shifts. You will be deemed to have accepted the terms of this agreement, regardless of whether you have signed it, if you accept an assignment with VIP. This agreement applies independently of the provisions of any Award or industrial agreement that might relate to any assignment to which you may be allocated, and does not incorporate its terms. We will provide you with details regarding: (a) your employment status; (b) wages and payments; (c) specific functions and duties; (d) hours and location of work; (e) direct employment with VIP or the Client; (f) uniform requirements; (g) any other matter required to be advised to you before commencing work at the time of allocating an assignment. 3.1 VIP will make superannuation contributions on your behalf in accordance with statutory requirements. 4. Responsibilities 4.1 After you have signed one of our application forms we will enter your details onto our database. 4.2 You will keep VIP advised of changes to your details on the application form. 4.3 We will keep you on our database unless: (a) we don't hear from you for 1 month; (b) you advise us that you are no longer interested in seeking work: or (c) we receive substantiated report(s) of unsatisfactory work performance or conduct: in which case we will inform you and we may make your file inactive on the database. 4.4 When one of VIP's Clients requests that we supply an employee to perform an assignment, we will consider whether you are skilled to perform the type of work requested, provided that you have called us weekly to let us know that you are available for work. 4.5 If you are suitable we may offer to employ you to perform the assignment or to be put forth to our Client for direct employment with them for the length of the assignment. 4.6 If you advise that you are available for a particular period, you will make every reasonable effort to ensure that you remain available to accept an offer of an assignment in that period. 4.7 You will be paid by VIP or directly by the Client if you accept an assignment and work as required. Payment of wages will be established when we place you on an assignment. 4.8 In the event that any excess payment is made to you, you authorise VIP to make the appropriate deductions from your following wages subject to the discovery of the error. In the event that employment has been terminated by either party prior to the subsequent pay you authorise VIP to deduct any monies owed from the bank accounts advised to VIP. Alternatively VIP and you may agree to a different repayment schedule. 4.9 When wages are paid directly by the Client you are for the term of the assignment deemed the Clients employee 4.10 Each time that you accept an assignment, you will be entering into a new contract of employment with VIP. The terms of these contracts will include the rights and obligations that apply to assignments as set out in this agreement. 4.11 You warrant that you: (a) possess the skills, experience and qualification/s set out in any resume provided to us or forms you complete, in connection with your application form; (b) you are lawfully entitled to work in Australia; (c) will ensure that any relevant application forms, licence or accreditation is renewed each year and a copy forwarded to VIP (provided you wish to continue employment with us); (d) your level of health and fitness is suitable for the performance of the genuine occupational requirements of the assignment; (e) you will not attend work if your ability to function effectively and safely is limited; (f) you will advise us with as much notice as is reasonable and practicable if you are or become limited in your capacity or unable to work for any reason including but not limited to: other unavoidable commitments, illegality, injury, illness, substance intake or fatigue; (g) you will complete any assignment accepted by you, unless you obtain VIP's consent not to complete an assignment. VIP will not unreasonably withhold such consent; (h) you will comply in every respect with VIP's direction, working methods, policies, procedures, guidelines and standards as issued and updated from time to time which you acknowledge take effect as orders given by VIP to you in the course of your employment by VIP which we may change, and not as mutually enforceable obligation; (i) you will follow the lawful and reasonable directions of the Client for which you have accepted an assignment; (j) you will complete time sheets required by VIP and the Client; (k) you will work with due care diligence and without negligence (l) you will utilise your skills to the best of your ability and judgment; (m) you will observe safe work practices; (n) you will work in accordance with relevant standards/competencies; (o) you will abide by legislation and workplace policies in relation to : Workplace Health and Safety, Discrimination, Equal Opportunity and Ethical Conduct; (p) you will advise VIP of any injuries you suffer or incidents in which you are involved whilst on assignment and during which someone is injured or suffers any loss, as soon as possible and complete an incident report if requested by VIP; (q) you will inform VIP if a Client asks you to work an additional shift to the assignment or an offer of full time employment is made; (r) you will not accept full time, casual or part time work offered to you directly by one of our Clients with whom you have worked for at any time within twelve months after the final assignment and will refer the Client to VIP in the event that any such offer is made; (s) you will maintain the confidentiality and privacy of information coming into your possession from whatever source, to the extent consistent with the proper performance of your duty to act in VIP's best interest; (t) you will be responsible for informing VIP in writing of any administrative matters needing our attention such as authority to release information to third parties etc and such information will only be effective as from the date of receipt either verbally or in writing; (u) you will attend VIP's office at a requested time and at your own cost whenever reasonably required to do so; (v) you understand that you are protected by Workers Compensation in the event of a workplace related accident, injury or disease. All workers compensation entitlements will be in accordance with statutory requirements. 5. Termination 5.1 VIP can terminate your employment and terminate this agreement on such minimum notice (if any) as may be required by law, for reasons that include but are not limited to: (a) you are guilty of any material breach of the rights and obligations that apply to assignments; (b) you are charged with any criminal offence or are involved in any conduct which is unprofessional or breaches any of our rules or standards in relation to ethical behaviour which, in our reasonable opinion brings you or VIP into serious disrepute; (c) you are guilty of misconduct; (d) one of our Clients no longer required you to perform the assignment; (e) you are prevented from working by industrial action, civil commotion or unrest, equipment breakdown or any other stoppage of work for which we are not responsible. Declaration I understand the Terms and Conditions of Casual (Hourly On Hire) Employment as detailed in the Candidate Declaration and agree to abide by VIP and its Clients rules, medical requirements, safety regulations, dress codes and any other conditions currently established (or as issued from time to time) on the Clients work site designated for any assignment.
